Terms and Conditions
1. Scope
These General Terms and Conditions apply to all orders placed via our online shop by consumers and businesses.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.
A business is a natural or legal person or a legally responsible partnership that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.
For businesses: If the business uses conflicting or supplementary general terms and conditions, their validity is hereby rejected. They only become part of the contract if we have expressly agreed to them.
2. Contracting Party, Conclusion of Contract, Correction Options
The purchase contract is concluded with Katja Burkhardt.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction tools provided and explained during the order process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.
3. Contract Language, Storage of Contract Text
The following languages are available for concluding the contract: German, English.
We store the contract text on our internal systems, which you do not have access to.
4. Delivery Conditions
Delivery Area
We deliver within Germany. We do not deliver to sanctioned areas, such as Russia.
Shipping Costs
Standard shipping costs apply in addition to the product prices stated. Details are specified in the respective offers.
Delivery Options
We deliver the products to the delivery address specified during the order process. Delivery is only available via shipping; self-collection is not possible. Delivery to parcel stations is not available.
5. Payment
The following payment methods are generally available in our shop:
Credit Card
You enter your credit card details during the order process. Your card will be charged immediately after placing the order.
SEPA Direct Debit
By placing the order, you grant us a SEPA direct debit mandate. We will notify you of the debit date at least one banking day in advance (so-called prenotification). A banking day is any working day except Saturdays, public holidays, and December 24 and 31. The debit takes place before shipping the goods.
Apple Pay
To pay via Apple Pay, provided by Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have Apple Pay activated, authenticate yourself, and confirm the payment order. The transaction will be executed immediately after placing the order. Further information is provided during the order process.
Google Pay
To pay via Google Pay, provided by Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have Google Pay activated, authenticate yourself, and confirm the payment order. The transaction will be executed immediately after placing the order. Further information is provided during the order process.
6. Right of Withdrawal
Consumers have the statutory right of withdrawal as described in the withdrawal policy.
Businesses are not granted a voluntary right of withdrawal.
7. Retention of Title
The goods remain our property until full payment has been made.
For businesses: We retain ownership of the goods until all claims arising from an ongoing business relationship have been fully settled. You may resell the goods in the ordinary course of business; you assign to us in advance all claims arising from this resale in the amount of the invoice value – regardless of any combination or mixing of the goods with a new item – and we accept this assignment.
You remain authorized to collect the claims, but we may also collect them ourselves if you fail to meet your payment obligations.
We will release the securities due to us upon your request to the extent that the realizable value of the securities exceeds our outstanding claims by more than 10%.

9. Dispute Resolution
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
10. Withdrawal Policy
Consumers have a right to withdraw from the contract within fourteen days.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last partial shipment or the last item.
To exercise your right of withdrawal, you must inform us (Katja Burkhardt, Birkenweg 9, 36145 Hofbieber, Germany, studio.katjaburkhardt@gmail.com, Phone: +49 174 9704308) by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
You may also complete and submit the model withdrawal form or any other clear statement electronically on our website www.katja-burkhardt.com. If you make use of this option, we will promptly send you confirmation (e.g., by email) of the receipt of such a withdrawal.
To meet the withdrawal deadline, it is sufficient to send your notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Original Works
Original artworks are excluded from the right of withdrawal.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive your withdrawal notification.
For this reimbursement, we will use the same payment method you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods that was not necessary for checking the quality, characteristics, and functioning of the goods.
